If you are buying or selling real estate, we will assist you to complete your contract by preparing the required conveyancing documents, attending to all necessary searches, adjusting rates and taxes, ensuring that the transfer of land is properly registered at Landgate and dealing with the sale proceeds in accordance with your instructions.
Our flat rate settlement fees are based on the cost of our service, not the value of your property.
Advice on real estate contracts
The standard-form real estate contract used in Western Australia, known as the Contract for Sale of Land or Strata Title by Offer and Acceptance, is generally prepared by the seller’s real estate agent. The standard contract is well understood within the industry and many people are happy to sign it without seeking legal advice. Difficulties are more likely to arise where parties attempt to amend the standard form contract by adding special conditions. In these circumstances, particularly where the conditions relate to the sale or exchange of another property or contemplate a building inspection as a condition of sale it is wise to obtain legal advice before you sign. If you have signed a contract, it is your responsibility to ensure that you understand your obligations under the contract. If the contract is subject to finance, you must comply strictly with the finance provisions or risk losing the benefits thereof. It’s better to be safe than sorry. If you are buying a home that has not yet been built or un-subdivided land (i.e. off-the-plan) the contract is generally extensive and drafted in favour of the developer. We charge an upfront fee of $550 to analyse the contract. This fixed fee is additional to our flat rate settlement fee. We need to do this in order to have a full understanding of the terms and conditions (which vary from contract to contract) and to advise you of your rights and obligations where there are delays in completion or changes to the works.
Default notices and enforcement action
Most settlements proceed smoothly. But if there’s a problem it’s good to know that your settlement lawyers have the resources to advise you of your rights and tackle the difficulty on the spot.
