Your pre-settlement inspection is important

In Western Australia you get one final inspection of the property in the 5 business days before you take possession and you can bring two people with you. It’s the last chance to raise anything before you pay the purchase price and complete settlement. The contract doesn’t entitle you to a second look.

What to look for

Check the property is in the same condition it was in immediately before the contract date. The seller has to remove all vehicles, rubbish and anything not sold with the house, but they aren’t obliged to do this until settlement is complete. Beyond that, nothing should have changed.

Check the special conditions too. Many contracts say the electrical, gas and plumbing fittings have to be in working order or that the seller will have done particular repairs. The final inspection is your opportunity to check these things.

If something is wrong

Raise it with the seller’s real estate agent first. The agent will usually go back to the seller and sort it out before settlement.

Tell your settlement agent or settlement lawyer at the same time. If it is not resolved, what you can do depends on what the contract says and on how long there is before the settlement date.

Can you inspect again?

Under the General Conditions you are not entitled to a second inspection before settlement. The parties can agree to one and the agent will often arrange it if there’s a reason, but you cannot insist.

So use the one you have properly. Take the two people the contract allows and photograph anything you’re not sure about.
